These Terms & Conditions govern the sale of products by DrCarpys & NwBait Lab Limited (“we”, “us”, “our”) via our website.

By placing an order through our website, you agree to be legally bound by these Terms.

2. Eligibility

By placing an order, you confirm that:

• You are at least 18 years old
• You are legally capable of entering into binding contracts
• The information you provide is accurate and complete

3. Products

All products are subject to availability.

We reserve the right to:

• Withdraw products at any time
• Limit quantities
• Refuse orders where necessary

Product images are for illustrative purposes. Actual products may vary slightly.

4. Pricing

All prices are displayed in GBP (£).

We reserve the right to change prices at any time.

Price changes will not affect orders already confirmed.

In the event of a pricing error, we reserve the right to cancel the order and issue a refund.

5. Orders & Contract Formation

An order placed on our website constitutes an offer to purchase goods.

A contract is formed only when we:

• Accept your order; and
• Dispatch the goods

We reserve the right to refuse or cancel any order at our discretion.

6. Payment

Payment must be made in full at the time of order.

Payments are processed securely via Shopify and authorised payment providers.

We do not store full card details.

7. Delivery

Delivery times are estimates only and not guaranteed.

Risk in the goods passes to you upon delivery.

Ownership of goods passes only when full payment has been received.

We are not liable for delays caused by:

• Courier services
• Customs processes
• Events beyond our reasonable control

8. Consumer Cancellation Rights (UK Customers)

Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods.

To exercise this right:

• You must notify us in writing within 14 days
• Goods must be returned within 14 days of cancellation
• Items must be unused and in original condition

Return postage costs are the responsibility of the customer unless the goods are faulty.

Refunds will be processed within 14 days of receiving the returned goods.

Exceptions apply to:

• Perishable goods
• Custom-made or personalised items
• Sealed items not suitable for return once opened

9. Faulty or Damaged Goods

Under the Consumer Rights Act 2015, goods must be:

• Of satisfactory quality
• Fit for purpose
• As described

If goods are faulty, you may be entitled to:

• Repair
• Replacement
• Refund

Please notify us within 30 days if you believe goods are faulty.

10. Limitation of Liability

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded under UK law

Subject to the above:

We shall not be liable for:

• Indirect or consequential losses
• Loss of profits
• Loss of business opportunity

Our total liability shall not exceed the value of the goods purchased.

11. Use of Website

You agree not to:

• Misuse the website
• Attempt unauthorised access
• Introduce malicious software

We reserve the right to suspend access if misuse is suspected.

12. Intellectual Property

All content on this website, including logos, branding, product descriptions and images, is the property of DrCarpys & NwBait Lab Limited unless otherwise stated.

Unauthorised reproduction is prohibited.

13. Force Majeure

We shall not be liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to:

• Natural disasters
• Strikes
• Supply chain disruption
• Government restrictions

14. Governing Law

These Terms are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Product-Specific Terms – Fishing Equipment & Bait

15.1 Fishing Equipment Disclaimer

Fishing equipment, including but not limited to rods, reels, hooks, terminal tackle, leads, rigs and accessories, may present inherent risks if used improperly.

By purchasing and using our products, you acknowledge that:

• Fishing activities involve risk of injury.
• Hooks and terminal tackle are sharp and may cause injury.
• Leads and weighted items may cause injury if misused.
• Rods and carbon products may conduct electricity and must not be used near overhead power lines.

DrCarpys & NwBait Lab Limited shall not be liable for injury, loss or damage arising from improper use, misuse, modification or failure to follow safe fishing practices.

Nothing in this clause excludes liability that cannot be excluded under UK law.

15.2 Bait & Perishable Products

Bait products (including boilies, wafters, pellets, liquids and other consumables) are perishable goods.

It is the customer’s responsibility to:

• Store bait in accordance with any storage guidance provided
• Keep products sealed where appropriate
• Refrigerate or freeze products where required
• Check use-by or best-before dates

We shall not be liable for deterioration, spoilage or reduced effectiveness resulting from improper storage after delivery.

Perishable goods are exempt from cancellation rights under the Consumer Contracts Regulations 2013 once dispatched, unless faulty.

15.3 Product Use & Suitability

It is the responsibility of the customer to ensure that products purchased are:

• Suitable for their intended use
• Compatible with other equipment
• Used in accordance with manufacturer recommendations

We do not guarantee specific fishing results, catch rates or performance outcomes.

15.4 Breakages & Rod Warranty

Fishing rods and certain tackle items are delicate sporting goods.

Customers must inspect items upon delivery and report any transit damage within 48 hours.

Damage caused by:

• Misuse
• High sticking
• Impact damage
• Incorrect assembly
• Wear and tear

is not covered unless covered by an applicable manufacturer warranty.

Where a manufacturer warranty applies, claims may need to be processed directly with the manufacturer.

15.5 Natural Variation

Certain bait products may vary in:

• Colour
• Texture
• Shape
• Scent

Such variations do not constitute defects where the product remains fit for purpose.

16.  International Orders

Customers are responsible for complying with the import laws and regulations of the destination country.

17. Payment Disputes

Chargeback Protection & Payment Dispute Policy

If a customer initiates a chargeback, payment dispute, or payment reversal without first attempting to resolve the issue directly with DrCarpys & NwBait Lab Limited, we reserve the right to take appropriate action.

Customers are required to contact our customer support team at support@drcarpys.co.uk before raising any payment dispute with their bank or payment provider.

Where a chargeback is filed:

• We may provide transaction records, delivery confirmation, and communication logs to the payment provider as evidence of order fulfilment.

If a chargeback is found to be unjustified or fraudulent, we reserve the right to:

• Suspend or terminate customer accounts

• Refuse future orders

• Recover administrative, legal, or financial costs incurred as a result of the dispute, where permitted by law

Nothing in this clause affects your statutory consumer rights.

18. Trade Sales & Brand Supply Policy

Retail and Manufacturing Separation

DrCarpys operates as a retail brand.

NwBait Lab represents our in-house product development and manufacturing brand.

Wholesale or trade supply of NwBait Lab products may be subject to separate commercial agreements.

Trade Customer Terms

Trade customers purchasing products for resale may be required to:

• Enter into written supply agreements where applicable
• Comply with brand pricing and distribution guidelines
• Maintain appropriate product storage and handling standards
• Obtain prior approval for resale channel use where required

We reserve the right to restrict trade supply where necessary to protect brand integrity and distribution structure.

Resale and Distribution Control

Unless expressly authorised in writing, trade customers may not:

• Repackage products under alternative branding
• Misrepresent product origin or manufacturer
• Distribute products outside agreed territories if such restrictions are applied
